CUSTOMER MUST CAREFULLY READ THIS SECTION:
Circle Performance Hereby Expressly Disclaims All Warranties Either Express Or Implied, Including Any Implied Warranty Of Merchant ability, Safety, Or Fitness For A Particular Purpose.
CUSTOMER UNDERSTANDS THAT RACING IS A DANGEROUS SPORT and the inherent dangers and risks involved therein, but are not limited to death, burns, serious neck and spinal injuries which may result in complete or partial paralysis, brain damage, serious injury to virtually all internal organs, serious injury to virtually all bones, joints, ligaments, muscles, tendons, and other parts of the muscular skeletal system, serious injury or impairment to other parts of his or her body, general health and well-being. Customer also understands that racing may additionally result in serious impairment of Customer’s future abilities to earn a living, to engage in other business, social, and recreational activities, and generally to enjoy life.
King Racing Products Warranty
CUSTOMER UNDERSTAND AND AGREES THAT NO WARRANTIES ARE MADE by King Racing Products, and any of its owners, shareholder, directors, officers, employees, agents, representatives, heirs, successors, assigns, insurers, and affiliates or any of them, either express or implied of merchant ability, fitness for a particular purpose of safety. King Racing Products and its above-mentioned affiliated parties will not be liable for any damages, loss or injury to property, loss of life, personal injury, or any other claim arising in any way, directly or indirectly, from product supplied by King Racing Products.
XRP Products Warranty
XRP, Inc. warrants that said products will be free from defects in materials and workmanship for 90 days from the date of original purchase, and this warranty is limited to repair or replacement of parts. This warranty shall not exceed the original purchase price of the goods, nor shall XRP, Inc. be responsible for special, incidental, or consequential damages. Any defective parts should be returned to the Dealer where purchased for any warranty adjustment.
CUSTOMER AGREES TO INDEMNIFY AND HOLDS HARMLESS Circle Performance and all it owners, shareholders, directors, officers, employees, agents, representatives, heirs, successors, assigns, insurers, and affiliates or any of them from any loss, liability, damage, or cost they or any other person may incur arising from the products supplied by Circle Performance on behalf of himself/herself, his/her personal representatives, assigns, heirs, and next of kin. Customer further agrees to reimburse Circle Performance or pay over to Circle Performance, all sums of money which Circle Performance or its or its above-mentioned affiliated parties pay or become liable to pay by any reason of any of the foregoing, and shall make those payments to Circle Performance as soon as they become liable thereon, whether or not Circle Performance shall have paid out those sums or any part thereof.
CUSTOMER UNDERSTAND AND AGREES that the price for all products supplied by Circle Performance reflects consideration for the Provisions of Warranty and that the price for said products would be higher if this Disclaimer of Warranty did not apply.
Acceptance And Use Of Any Products Supplied By King Racing Products Will Constitute Acceptance Of These Terms!! If Customer does not agree to these terms, Customer should promptly return the products for a full refund, all shipping costs at Customer’s expense, to Circle Performance.
